Terms of Use

tacit sends one bit of information between two people. It is not a messaging service, not a scheduling tool, and not a substitute for a conversation. A tap is a signal, never a commitment.

1. Agreement

These terms are between you and Rst.com Inc. (株式会社Rst.com), Japan (“we”, “us”). By using the tacit app you agree to them. If you do not agree, please do not use the app.

2. What tacit does

tacit lets two paired people each indicate, once per day, that they are open to intimacy — without either of them having to raise it out loud. Each person sees only whether the other has tapped today. The state resets when the date changes and no history is kept.

3. Requirements

tacit is intended for adults. You must be old enough to form a binding contract where you live.

4. Consent

This is the most important section of these terms.

A signal in tacit means only that a person felt open at the moment they tapped. It is not consent, it does not carry over to any later moment, and it creates no obligation of any kind. Either person may change their mind at any time, for any reason or none, whether or not the app shows a match. Consent is given between people, in the moment, and can always be withdrawn.

You must not use tacit to pressure, monitor, coerce, or keep score against your partner, and you must not install it on someone else’s device or ask them to use it against their wishes. The app deliberately keeps no history precisely so that it cannot be used this way.

5. Price and tips

tacit is free and every feature works without paying. The app offers an optional tip through Apple’s In-App Purchase. A tip unlocks nothing — it is a voluntary contribution toward the cost of keeping the app available.

All purchases are processed by Apple. Refunds are handled by Apple under the terms of the App Store, not by us.

tacit depends on Apple’s iCloud, CloudKit, and push notification services. We cannot guarantee that a signal or a notification will be delivered, or delivered promptly. Delivery may be delayed or fail because of network conditions, device settings, or changes on Apple’s side. Do not rely on tacit for anything time-critical.

The app is provided “as is”, without warranties of any kind, to the fullest extent permitted by law.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of tacit, including any effect on a relationship. Nothing in these terms limits liability that cannot be limited under applicable law, including liability for intentional misconduct or gross negligence.

If you are a consumer, you keep all rights granted to you by the consumer protection laws of your country, and nothing here overrides them.

9. Changes and ending use

We may update the app or these terms. Material changes will be posted on this page with a new effective date. We may discontinue tacit at any time. You may stop using it at any time by unpairing and deleting the app.

10. Governing law

These terms are governed by the laws of Japan. Disputes will be subject to the exclusive jurisdiction of the court with jurisdiction over our principal place of business, unless mandatory consumer law in your country provides otherwise.
